1. Scope and provider
These Terms of Use apply to Website Reviews, including automated website analyses, comparisons, user accounts, saved websites, monitoring and paid Premium features. The service is provided by Dennis Kost, Gerther Str. 42, 44805 Bochum, Germany; email: [email protected].
2. Automated analysis and limitations
Website Reviews automatically analyses publicly accessible websites. Results are based on technical snapshots, externally available information and automated scoring rules. They may be incomplete, delayed or inaccurate and may change when a website is analysed again. Reports are not legal advice, a privacy audit, security certification, penetration test or binding SEO advice, and no specific ranking, traffic, commercial outcome or legal compliance is guaranteed.
3. Permitted use and public reports
Only publicly accessible domains and URLs may be submitted. The service must not be used to bypass authentication, access restrictions or technical protection measures, or for unlawful, abusive or harmful activity. Automated abuse, excessive bulk requests and circumvention of technical usage limits are prohibited.
Submitted domains and generated reports may be publicly accessible, appear in lists, search features, comparisons and sitemaps, and may be indexed by search engines. Users must not submit confidential or non-public URLs, credentials or other secrets.
4. External websites and third-party rights
Website Reviews does not adopt the content of analysed or linked websites as its own. Trademarks, names, content, logos and other rights remain with their respective rights holders. A technical analysis does not imply affiliation, endorsement or partnership with the operator of the analysed website.
5. User accounts
Certain features require an account. Registration information must be accurate and credentials must be kept confidential. Users should promptly inform Website Reviews if they suspect misuse of their account.
6. Free and Premium features
Website Reviews may divide features into free, account-based and paid service levels. Individual features and their presentation may evolve. For an active paid subscription, the material features and price shown when the contract is concluded apply.
7. Premium subscription, prices and billing
Premium is offered as a recurring subscription. Available billing intervals may include monthly and annual plans. The specific price, billing interval and recurring nature of the payment are displayed before purchase in Website Reviews and/or Stripe Checkout. A subscription renews for the selected billing interval until effectively cancelled.
Payments are processed through Stripe. Website Reviews may use Stripe Checkout and the Stripe-hosted customer portal to manage existing subscriptions.
8. Cancelling Premium
A Premium subscription can be cancelled through the subscription-management option provided by Website Reviews and/or the Stripe customer portal where available. A cancellation scheduled for the end of the current billing period stops automatic renewal; Premium access generally remains available until the end of the already paid period. Mandatory statutory rules remain unaffected.
9. Failed payments
If a recurring payment cannot be collected successfully, Premium access may be restricted depending on the payment and subscription status or, once the subscription ends, returned to the free or registered service level. Mandatory statutory rights remain unaffected.
10. Consumer rights and withdrawal
Mandatory consumer-protection law applies to consumers. Where a statutory right of withdrawal applies to a paid contract, the required information must be provided separately in connection with the purchase process. These Terms of Use do not replace any legally required withdrawal information.
11. Monitoring and availability
Monitoring is a convenience feature and does not replace independent monitoring of business-critical systems. Checks, notifications and results may be delayed or unavailable because of maintenance, queues, external services or technical failures. There is no entitlement to permanent availability of free features. Mandatory statutory rights and contractual obligations remain unaffected for paid services.
12. Liability
Liability is governed by applicable law. In particular, liability for intent and gross negligence, injury to life, body or health and other mandatory statutory liability remains unaffected. No additional guarantee of quality, completeness or results is given for automated analysis outcomes.
13. Suspension for misuse
Where use is recognisably abusive, unlawful or creates a security risk, analyses, monitoring or accounts may be temporarily restricted or suspended where necessary and proportionate to protect the service or third parties.
14. Privacy
Information about the processing of personal data is provided in the Privacy Policy.
15. Changes and governing law
These Terms may be amended for the future where necessary because of new features, changed legal requirements or technical developments. Changes affecting existing paid contractual relationships will be made only within applicable legal and contractual requirements.
German law applies without depriving consumers of mandatory consumer protections applicable in the country of their habitual residence. If any provision is invalid or becomes invalid, the remaining provisions remain unaffected to the extent permitted by law.
